Terms of Use — VinForFree.com

Please read these Terms of Use (“Terms”) carefully before using VinForFree.com (the “Site”). By accessing or using the Site — including any free or paid features — you (“User,” “you”) agree to be legally bound by these Terms in full. If you do not agree, you must immediately stop using the Site.

These Terms constitute a legally binding agreement between you and VinForFree LLC, a Michigan limited liability company (“we,” “us,” “our,” “VinForFree LLC”).

1. Acceptance of Terms

By using the Site, clicking “I Agree,” checking any checkbox, completing a purchase, or simply browsing the Site, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You agree to these Terms, our Privacy Policy, and our Disclaimer
  • Your use complies with all applicable federal, state, local, and international laws
  • You are accessing the Site for lawful purposes only

If you are using the Site on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

Geographic Restriction: This Site is intended for use by residents of the United States only. If you are located outside the United States, you access this Site at your own risk and you are solely responsible for compliance with the laws of your jurisdiction. VinForFree LLC makes no representation that the Site or its content is appropriate or legally available in locations outside the United States. By accessing this Site from outside the United States, you acknowledge that you do so voluntarily and that VinForFree LLC is not required to comply with any non-US law, regulation, or legal framework as a result of your access.

2. Description of Services

VinForFree.com provides the following services:

  • Free VIN Reports: Vehicle identification number decoding, NHTSA recall data, EPA fuel economy data, consumer complaints, crash test ratings, and estimated market value — sourced from publicly available government databases. These services are provided free of charge.
  • VIN Pro Plus ($4.99/report): A paid upgrade that provides additional vehicle history data including accident history, title records, odometer history, ownership records, and auction data sourced from third-party licensed data providers.
  • License Plate Lookup: Conversion of a license plate number and state to a Vehicle Identification Number (VIN) via a third-party API. This service does not return any personally identifiable information about the vehicle’s owner.
  • VIN Camera Scan: An in-browser OCR tool to assist users in reading a VIN from a photo. All processing occurs locally in your browser; no image is transmitted to our servers.
  • Supplemental Tools: Vehicle comparison tools, reliability ratings, OBD code lookup, and state automotive law information.

3. Informational Purpose Only — Critical Limitation

ALL DATA ON THIS SITE IS PROVIDED FOR INFORMATIONAL AND RESEARCH PURPOSES ONLY.

Vehicle history data — whether free or paid — is inherently and unavoidably incomplete. VinForFree LLC does not guarantee, warrant, or represent that any report reflects the complete, accurate, or current history of any vehicle. You expressly acknowledge and agree that:

  • Not all vehicle accidents are reported to law enforcement or insurance companies, and therefore not all accidents appear in any database
  • Not all states report title transactions to all national databases, and reporting timelines vary significantly by jurisdiction
  • Title brands, odometer fraud, and other flags may not appear in databases until weeks or months after the relevant event
  • Private party vehicle sales often do not generate reportable data
  • Data providers may have gaps, errors, delays, or outages beyond our control
  • A clean or clear report does NOT guarantee that a vehicle has no accident history, title issues, odometer discrepancies, flood or fire damage, or any other defect
  • The absence of negative information in a report is NOT evidence of a clean vehicle history
  • Report data reflects what was in the relevant databases at the exact time of the query. Events occurring after the query — including newly filed title brands — will not appear

No report from VinForFree.com, whether free or paid, should ever be your sole basis for any vehicle purchase decision. You should always obtain an independent mechanical inspection from a qualified automotive professional before purchasing any used vehicle, regardless of what our report shows.

4. Assumption of Risk — Vehicle Purchase Decisions

YOU EXPRESSLY ASSUME ALL RISK ASSOCIATED WITH ANY VEHICLE PURCHASE DECISION, REGARDLESS OF THE CONTENT OF ANY REPORT PROVIDED BY VINFORFREE LLC.

You acknowledge and agree that:

  • You are solely responsible for any vehicle purchase decision you make, with or without reference to any report from this Site
  • VinForFree LLC has no involvement in, and bears no responsibility for, any vehicle transaction between you and any seller, dealer, auction house, or other party
  • Any financial loss, mechanical damage, repair costs, diminished value, or other harm arising from a vehicle purchase — including but not limited to purchasing a “lemon,” flood-damaged vehicle, salvage vehicle, odometer-rolled vehicle, or vehicle with undisclosed accident history — is your sole responsibility
  • A VIN Pro Plus report is a data access service, not an inspection, certification, guarantee, or warranty of any kind
  • Paying for a VIN Pro Plus report does not transfer any liability to VinForFree LLC for the condition, history, or fitness of any vehicle
  • You assume full financial and legal responsibility for any vehicle you purchase, regardless of what our data shows or does not show

5. License Plate Lookup — DPPA Compliance

VinForFree LLC offers a License Plate Lookup feature that converts a license plate number and state to a Vehicle Identification Number (VIN). This feature is subject to the federal Driver’s Privacy Protection Act (DPPA), 18 U.S.C. §§ 2721–2725.

Before submitting any license plate lookup request, you must certify that you have a permissible purpose under the DPPA. By checking the required certification checkbox and submitting a lookup request, you represent and warrant that:

  • You have a permissible purpose under the DPPA for requesting the information
  • You will not use the returned VIN or any associated information to locate, stalk, harass, or harm any individual
  • You will not use the returned information for any purpose prohibited by the DPPA
  • All information you have provided, including your stated permissible purpose, is true and accurate

False DPPA Certification: Providing a false certification of permissible purpose is a federal crime under 18 U.S.C. § 2722 and may subject you to criminal prosecution, civil liability, and fines. By submitting a lookup request with a false certification, you fully indemnify VinForFree LLC against any claim, fine, penalty, or liability arising from your misrepresentation. VinForFree LLC logs all plate lookup requests including IP address, timestamp, plate and state entered, and DPPA certification status. This log may be provided to law enforcement upon lawful request.

We reserve the right to terminate your access immediately and without refund upon any suspected DPPA violation. VinForFree LLC is not liable for any User’s misuse of the License Plate Lookup feature in violation of the DPPA or any other applicable law.

6. Prohibited Use — FCRA

VIN Pro Plus reports are NOT consumer reports as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.

You expressly agree that you will NOT use any report from VinForFree.com for:

  • Employment decisions or background screening of any kind
  • Credit eligibility or creditworthiness determinations
  • Insurance eligibility, underwriting, or rating decisions
  • Tenant screening or housing eligibility determinations
  • Any other purpose regulated by the FCRA

Using our reports for any FCRA-regulated purpose is strictly prohibited, constitutes a material breach of these Terms, and may expose you to civil and criminal liability under federal law. VinForFree LLC is not a consumer reporting agency and does not provide consumer reports. We shall not be held liable for any User’s misuse of report data in violation of the FCRA.

7. Acceptable Use Policy

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Site for any purpose that is unlawful, fraudulent, harmful, or prohibited by these Terms
  • Attempt to scrape, crawl, harvest, or systematically extract data from the Site without express written permission
  • Use automated tools, bots, or scripts to access or query the Site
  • Resell, sublicense, redistribute, or commercially exploit any report or data obtained from the Site without our written consent
  • Attempt to reverse engineer, disassemble, or decompile any portion of the Site
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Transmit any virus, malware, or other harmful code to or through the Site
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Use any report to harass, stalk, threaten, or harm any individual
  • Use the Site in any manner that could damage, disable, overburden, or impair the Site or our servers
  • Violate any applicable law, including the DPPA, FCRA, or any state vehicle data privacy law

8. Paid Reports — VIN Pro Plus

8a. Payment and Access

VIN Pro Plus reports are available for a one-time fee of $4.99 per report. Payment is processed securely by Stripe, Inc. By completing a purchase you agree to Stripe’s terms of service. All sales are final except as provided in Section 8b below.

8b. Refund Policy

Due to the nature of digital data delivery, all VIN Pro Plus sales are final and non-refundable once a report has been generated and delivered. A refund may be issued at our sole discretion in the following limited circumstances only:

  • The report could not be generated due to a confirmed system error on our part
  • You were charged more than once for the same report due to a payment processing error

We do not issue refunds because you are dissatisfied with the data returned, because a report shows less information than you expected, or because a vehicle’s history is not what you hoped. Data availability varies by vehicle and is outside our control.

8c. Paid Report Disclaimer

Payment for a VIN Pro Plus report does not guarantee the completeness, accuracy, or currency of the data returned. You are paying for access to data from third-party licensed data providers — not for a guarantee, warranty, inspection, or certification of any kind. VinForFree LLC makes no warranty, express or implied, as to the accuracy or completeness of any paid report.

8d. Report Delivery

Reports are delivered digitally via the Site and optionally by email. Report access links expire 72 hours after generation. We are not responsible for any failure to receive an emailed report due to spam filters, incorrect email addresses, or email provider issues.

9. Third-Party Data Providers

The data displayed on VinForFree.com is sourced from third-party data providers, including but not limited to NHTSA, EPA, TorqueNode, and other licensed data services. VinForFree LLC does not independently verify, create, or control this data.

You acknowledge and agree that:

  • VinForFree LLC is not responsible for any errors, omissions, inaccuracies, or delays in data provided by third-party sources
  • Data provider outages, API failures, or service interruptions may result in incomplete or unavailable reports
  • In the event of a third-party data provider error resulting in a materially incorrect report, our sole obligation is to attempt to re-generate the report or issue a refund at our discretion — we shall not be liable for any consequential damages arising from such errors
  • Third-party data providers may change their data, APIs, or service offerings without notice to us

10. Intellectual Property

All content on this Site — including but not limited to text, graphics, logos, the VFF Score methodology, the VIN Quality Score methodology, software, and design — is the property of VinForFree LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial informational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this Site without our prior written consent.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, REPORTS, DATA, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VINFORFREE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES
  • ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR QUALITY OF ANY DATA OR REPORT
  • ANY WARRANTY THAT A REPORT REFLECTS THE TRUE OR COMPLETE HISTORY OF ANY VEHICLE
  • ANY WARRANTY THAT USE OF THE SITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

Some jurisdictions do not permit the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the maximum extent permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VINFORFREE LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, DATA PROVIDERS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY REPORT, INCLUDING BUT NOT LIMITED TO:

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
  • VEHICLE PURCHASE LOSSES, REPAIR COSTS, DIMINISHED VALUE CLAIMS, OR LEMON VEHICLE LOSSES OF ANY KIND
  • LEGAL DISPUTES BETWEEN BUYERS, SELLERS, DEALERS, OR ANY THIRD PARTY ARISING FROM REPORT DATA
  • DAMAGES ARISING FROM DATA INACCURACY, OMISSION, INCOMPLETENESS, DELAY, OR UNAVAILABILITY
  • DAMAGES ARISING FROM YOUR RELIANCE ON ANY FREE OR PAID REPORT
  • DAMAGES ARISING FROM THIRD-PARTY DATA PROVIDER ERRORS, FAILURES, OR SYSTEM OUTAGES
  • DAMAGES ARISING FROM FORCE MAJEURE EVENTS INCLUDING NATURAL DISASTERS, WAR, CYBERATTACKS, GOVERNMENT ACTION, OR ANY EVENT BEYOND OUR REASONABLE CONTROL
  • DAMAGES ARISING FROM YOUR USE OF THE LICENSE PLATE LOOKUP FEATURE OR RELIANCE ON ANY PLATE-TO-VIN RESULT

THIS LIMITATION APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, CONSUMER PROTECTION LAW, OR ANY OTHER LEGAL THEORY, EVEN IF VINFORFREE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF VINFORFREE LLC TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM, OR (B) TEN DOLLARS ($10.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law. If you are a consumer in the European Union, the above limitations do not affect your statutory rights under EU consumer protection law.

13. Indemnification

You agree to indemnify, defend, and hold harmless VinForFree LLC, its members, managers, employees, agents, data providers, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or any report
  • Your violation of these Terms
  • Your violation of any applicable law, including the DPPA or FCRA
  • Any false or fraudulent DPPA certification you have provided
  • Any misrepresentation of your identity, purpose, or authority
  • Any unauthorized use or redistribution of report data
  • Any vehicle purchase decision you make based on or in connection with any report
  • Any dispute between you and a third party, including vehicle sellers, dealers, or auction houses
  • Any claim brought by a third party arising from data you obtained from our Site

14. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

14a. Informal Resolution

Before initiating any formal dispute, you agree to contact us at supportvinforfree@gmail.com and attempt to resolve the issue informally for at least 30 days. Most concerns can be resolved this way.

14b. Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Disclaimer, or your use of the Site — including questions about the validity, enforceability, or scope of this arbitration clause — shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14c. Class Action Waiver

YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought in your individual capacity only. No arbitration or proceeding shall be joined with any other without the prior written consent of all parties.

14d. Jury Trial Waiver

YOU EXPRESSLY WAIVE YOUR RIGHT TO A JURY TRIAL for any dispute covered by these Terms, to the fullest extent permitted by applicable law.

14e. Exceptions

Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Small claims court actions within the applicable jurisdictional limits are also permitted.

14f. Arbitration Costs

AAA filing fees shall be governed by the AAA Consumer Arbitration Rules. For claims under $10,000, we will pay all AAA filing, administrative, and arbitrator fees unless the arbitrator finds your claim to be frivolous or filed in bad faith.

14g. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. For any matters not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in Wayne County, Michigan.

14h. International Users

If you are located outside the United States, you agree that any dispute shall still be governed by Michigan law and resolved through binding arbitration as described above. You waive any right to invoke the laws of your home country in connection with any dispute arising from your use of this Site. If any provision of this arbitration agreement is unenforceable under the law of your jurisdiction, the remaining provisions shall remain in full force and effect.

15. International Users and Jurisdiction-Specific Notices

15a. European Union / European Economic Area Users (GDPR)

If you are located in the EU or EEA, please note that this Site is not directed at EU/EEA residents and does not offer services specifically to persons in the EU/EEA. Our Privacy Policy describes how we handle personal data. To the extent EU General Data Protection Regulation (GDPR, Regulation 2016/679) applies to your use of this Site, you acknowledge that VinForFree LLC processes data in the United States, which may not provide the same level of data protection as your home country. By using this Site, you consent to this transfer. You may exercise your GDPR rights (access, rectification, erasure, portability, restriction, objection) by contacting info@vinforfree.com. We will respond within 30 days where feasible.

15b. United Kingdom Users (UK GDPR)

UK users are subject to the same provisions as EU users above, with reference to the UK GDPR and Data Protection Act 2018.

15c. California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete your personal information, the right to opt out of sale of personal information, and the right to non-discrimination for exercising your rights. 15d. Canadian Users (PIPEDA / Law 25)

If you are a Canadian resident, your use of this Site is governed by these Terms. We collect only the personal information described in our Privacy Policy and retain it only as long as necessary for the purposes described. You may request access to or correction of your personal information by contacting info@vinforfree.com.

15e. Australian Users (Privacy Act 1988)

Australian users acknowledge that this Site is operated from the United States and that their personal information may be transferred to and processed in the United States. We comply with the Australian Privacy Principles to the extent reasonably practicable for a US-based small business.

15f. All Other International Users

By using this Site from any jurisdiction outside the United States, you: (a) acknowledge that this Site is operated under US law; (b) accept that your data will be processed in the United States; (c) agree that any dispute will be resolved under Michigan law; and (d) acknowledge that you are responsible for compliance with all laws applicable in your jurisdiction. If use of this Site is prohibited or restricted in your jurisdiction, you must not use it.

16. Force Majeure

VinForFree LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: acts of God or nature; war, terrorism, or civil unrest; government orders, sanctions, or regulations; internet or telecommunications outages; third-party data provider failures or service interruptions; cyberattacks or data breaches; pandemics or public health emergencies; or any other event beyond our reasonable control. In such events, our obligations are suspended for the duration of the force majeure event.

17. Modifications to Terms

We reserve the right to update or modify these Terms at any time. We will update the “Last Updated” date at the top of this page. For material changes, we will make reasonable efforts to notify users. Your continued use of the Site after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

18. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Paid report access may be terminated without refund upon a violation of these Terms. Sections 3, 4, 5, 6, 10, 11, 12, 13, 14, and 15 shall survive any termination of these Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction or arbitrator, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and VinForFree LLC with respect to your use of the Site and supersede all prior or contemporaneous agreements, representations, warranties, or understandings.
